1. Acceptance of Terms

By accessing and using the Fresno Pallets website (fresnopallets.com), requesting quotes, placing orders, or engaging with our services in any capacity, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site and our services.

These terms apply to all visitors, users, customers, and others who access or use our website and services. We reserve the right to update or modify these terms at any time without prior notice. Your continued use of the website following any changes constitutes acceptance of the revised terms.

2. Products and Services

Fresno Pallets provides pallet products and related services including but not limited to the sale of new and used pallets, pallet recycling, pallet repair, heat treatment, custom manufacturing, transportation, logistics, and pallet removal. All products and services are subject to availability.

Product descriptions, specifications, and images on our website are provided for informational purposes and may not exactly represent the products delivered. Used and recycled pallets are classified by grade (A, B, C, Economy) and while we make every effort to deliver pallets consistent with the grade ordered, minor variations in appearance and condition are inherent to recycled products and do not constitute a defect or warranty claim.

Pricing displayed on our website is subject to change without notice and may not reflect the most current pricing. All quotes provided are valid for 30 days from the date of issue unless otherwise specified in writing.

3. Orders and Fulfillment

Orders placed through our website, phone, email, or in person are subject to acceptance by Fresno Pallets. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

Delivery timeframes provided are estimates and not guarantees. While we make every effort to meet stated delivery timelines, delays may occur due to factors beyond our control including weather, transportation disruptions, supply chain issues, or other circumstances. Fresno Pallets shall not be held liable for losses resulting from delivery delays.

Upon delivery, the customer is responsible for inspecting the pallets and reporting any discrepancies, damage, or quality issues within 48 hours of receipt. Claims made after this period may not be honored. The customer assumes responsibility for products once they are delivered to the designated location.

4. Payment Terms

Payment is due according to the terms agreed upon at the time of order. For new customers, payment is typically required upon delivery (COD) or via prepayment. Established business accounts with approved credit may be eligible for Net-30 payment terms at the sole discretion of Fresno Pallets.

We accept payment by credit card (Visa, Mastercard, American Express), ACH bank transfer, company check, and wire transfer. A service fee may apply to credit card transactions on large orders.

Late payments are subject to a 1.5% monthly interest charge (18% annually) on the outstanding balance. Accounts that are more than 60 days past due may be referred to a collections agency. The customer is responsible for all collection costs, including reasonable attorney fees, if collection efforts become necessary.

5. Limitation of Liability

To the fullest extent permitted by law, Fresno Pallets, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• •Your use or inability to use our website, products, or services.
• •Any unauthorized access to or alteration of your transmissions or data.
• •Any product defects, damage, or performance issues beyond normal wear and the specified grade tolerance.
• •Delays in delivery or fulfillment of orders.

In no event shall our total liability to you for all claims arising from the use of our products or services exceed the amount you paid for the specific products or services giving rise to the claim.

6. Product Warranty

New pallets manufactured by Fresno Pallets are warranted to be free from defects in materials and workmanship at the time of delivery. This warranty covers structural failures under normal use conditions within the specified weight capacity for a period of 90 days from the date of delivery.

Used and recycled pallets are sold "as-is" within their classified grade. While we inspect all pallets to ensure they meet the standards of their assigned grade, used pallets have inherent variations in condition, and minor cosmetic differences between individual pallets within the same grade are normal and expected.

This warranty does not cover damage caused by misuse, overloading beyond the rated capacity, improper handling, exposure to extreme conditions, chemical contamination, or modifications made by the customer. Warranty claims must be submitted in writing within the warranty period and are subject to inspection by Fresno Pallets.

7. Modifications and Termination

Fresno Pallets reserves the right to modify, suspend, or discontinue any aspect of our website, products, or services at any time without notice. We may also revise these Terms of Service at any time by updating this page. Changes are effective immediately upon posting.

We reserve the right to terminate or suspend access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Service. All provisions of these terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising from these terms or your use of our products and services shall be resolved in the state or federal courts located in Fresno County, California.
